Intellectual Property and Fan Content Policy
Slug: /legal/ip-and-fan-content Version: 0.2.0 Status: OWNER APPROVED — 0.2.0 Proposed effective date: [PROPOSED EFFECTIVE DATE] Audience: Players, fans, creators, streamers, reviewers, researchers, press, and anyone who wants to use Echoes of Eidolon material outside ordinary gameplay.
Plain-language summary
This policy distinguishes Eidolon Gaming's original intellectual property from third-party rights and public-domain cultural or historical material. It provides a default permission for noncommercial fan activity, avoids claiming ownership of cultures or traditions, and leaves unresolved monetized-streaming permissions clearly configurable rather than inventing them.

- What changed / version notes
1. What Eidolon Gaming owns
Subject to third-party rights and public-domain material, Eidolon Gaming owns or licenses the original software, code, fictional setting additions, original characters, narrative text, visual designs, artwork, logos, music, sound, interface assets, documentation, and other protected content created for Echoes of Eidolon. Copyright, trademark, patent, trade-secret, and other rights apply only to the extent recognized by law and actually owned or licensed.
2. Third-party material
Some content, tools, fonts, libraries, models, provider services, source material, or licensed assets may belong to third parties and remain subject to their terms. This fan-content policy cannot grant rights that Eidolon Gaming does not own. If a third-party notice imposes a narrower rule on a particular asset, that rule controls for that asset.
3. Public-domain and cultural material
Echoes of Eidolon draws on real cultures, histories, traditions, languages, objects, music, architecture, folklore, historical events, and scholarship. Eidolon Gaming does not claim ownership of a culture, tradition, language, community, public-domain historical fact, or public-domain cultural heritage merely because the game researches, depicts, adapts, translates, or combines it with fictional material.
An Eidolon-created illustration, recording, arrangement, translation, fictional addition, or other original expression can be protected without converting the underlying culture or public-domain source into Eidolon property.
4. Player and creator pre-existing rights
You keep ownership of intellectual property you already own. Using an Eidolon service, submitting feedback, or making fan content does not transfer ownership of your unrelated pre-existing work to Eidolon Gaming. Licenses granted through specific product terms are limited to the purposes stated there, such as operating a submitted feature or using product feedback for improvement.
5. Trademarks and source identification
Eidolon Gaming names, logos, and distinctive source identifiers may be trademarks or protected branding. Fan use must not falsely suggest that a fan project, website, event, product, account, or publication is official, sponsored, approved, endorsed, or operated by Eidolon Gaming. Where practical, identify fan projects as unofficial.
6. Default noncommercial fan permission
Unless a specific asset or separate license says otherwise, Eidolon Gaming permits reasonable noncommercial fan activity using limited portions of Echoes of Eidolon content, including fan art, fan fiction, cosplay, community discussion, criticism, reviews, guides, and transformative fan projects. This permission is revocable for material violations and does not transfer ownership.
The permission does not authorize selling copied game assets, manufacturing unlicensed merchandise, charging for access to substantial reproductions of the game, or distributing substitute products that compete with the original game or Store merchandise.
7. Screenshots and clips
You may use reasonable screenshots or short clips for noncommercial commentary, reviews, guides, fan discussion, accessibility reporting, bug reports, and similar transformative or informational purposes, subject to beta-specific restrictions that were clearly presented and accepted, privacy rights of other people, and applicable law.
Do not remove ownership notices in a misleading way or use screenshots to falsely imply endorsement. Large-scale scraping, asset extraction, or redistribution is not converted into permitted fan use merely by labeling it a screenshot collection.
8. Streaming and video
Noncommercial streaming and video commentary are permitted under the default fan permission, subject to the same restrictions on endorsement, privacy, unreleased protected material, and raw-asset redistribution.
Commercially monetized or ad-supported video/streaming permission is: [MONETIZED VIDEO/STREAMING PERMISSION]. Until that configuration is replaced with an owner-approved public rule, this policy does not grant a broader commercial license beyond rights that applicable law independently provides.
9. Fan works and transformative use
Fan works should add original expression, commentary, criticism, parody, analysis, community value, or another transformative element rather than simply republish substantial game content. Do not present a fan continuation, rulebook, soundtrack, database, or art collection as an official release. Do not use cultural material in a way that suggests Eidolon Gaming owns the underlying culture merely because the fan work references an Eidolon adaptation.
10. Raw game assets and source packages
Do not redistribute raw game asset bundles, source-code packages, proprietary databases, unreleased builds, model prompts, internal tooling, or other packaged materials unless Eidolon Gaming has expressly authorized that distribution or applicable law independently permits it. Extracting a protected asset from the game does not by itself create permission to republish the asset file.
11. Commercial merchandise and paid products
The default fan permission does not authorize selling apparel, posters, mugs, games, books, digital downloads, NFTs, physical collectibles, or other products using Eidolon-owned protected expression or trademarks. A separate written commercial license is required unless applicable law independently permits the use. This restriction does not apply to selling a lawfully purchased original physical item where resale rights apply.
12. No misleading endorsement or official status
Do not use Eidolon branding, staff names, website design, account names, or copied notices to make a fan project appear official. If there is a reasonable risk of confusion, use a clear statement such as “Unofficial fan project; not affiliated with or endorsed by Eidolon Gaming.” A disclaimer does not cure fraud or deliberate impersonation.
13. Cultural attribution and corrections
Fan permissions do not alter the Cultural Use, Attribution, and Research Corrections Policy. Public-domain cultural heritage remains public-domain where the law treats it that way. If a game asset contains a factual attribution error or raises a sacred/restricted-use concern, the correction process can be used even though Eidolon may own copyright in its particular original artwork or fictional adaptation.
14. Takedown and rights concerns
If you believe Eidolon Gaming content infringes your rights, or a fan use violates Eidolon-owned rights, use /contact and select Legal notice. Include enough information to identify the material, the right asserted, the location of the material, and a way to respond. Do not submit unnecessary passwords, payment-card data, access tokens, recovery codes, or government IDs.
We may ask for additional information reasonably needed to evaluate the claim and may remove or restrict material while a credible claim is reviewed.
15. DMCA notice status
A Digital Millennium Copyright Act agent and formal DMCA notice procedure should be published only if the required registration and operational prerequisites have actually been satisfied. Current agent information: [DMCA AGENT — IF REGISTERED].
Until that placeholder is replaced with verified registration details, do not present Eidolon Gaming as having a registered DMCA agent or instruct claimants to rely on an unverified statutory-agent address.
16. Reservation of rights
Rights not expressly granted by this policy are reserved. We may withdraw a fan permission for a material violation, infringement, fraud, harmful impersonation, security abuse, or another lawful reason, but we will not use this reservation to claim ownership of public-domain culture, user pre-existing IP, or rights the law does not grant Eidolon Gaming.
17. Contact
IP, trademark, infringement, or legal notices: /contact → Legal notice. Cultural/research sourcing concerns should use /contact → Historical/cultural correction or sourcing concern. Player support messages should be sent from the Support tab, not this webform.

19. What changed / version notes
Version 0.2.0 establishes the owner-approved distinction between original Eidolon IP and cultural/public-domain source material, a default noncommercial fan permission, limits on raw-asset redistribution and misleading endorsement, and explicit placeholders for monetized streaming and DMCA-agent status that remain unresolved.
